Cohl Out At Live Nation

Livenation221205_2Michael Cohl has "transitioned to a consultant role" from his post as CEO of  Live Nation's Artists division, effective immediately and resigned as a member of the company's Board of Directors.

Cohl is responsible for the 360 deals with JAY-Z and Madonna and the company is also nearing completion of a long-term agreement with U2. But insiders say that Cohl's deals were too costly and the statement released by Live Nation hints at that. " We are committed to acquiring additional artists' rights beyond the concert tour..." said CEO  Micahel Rapino. "At the same time, we continue to take a disciplined financial approach and are focused on expanding cash flow and margins and increasing value for shareholders."

Oh, the joys of running a publicly traded company.

Qbox: A Test Of Hypebot's Collective Intelligence

Recently, I took a look at Qbox, an online service that indexes the music on MySpace, YouTube and Bebo and lets users search, organize, and listen to it all via a single point of access. I liked what I saw.

Brain Qbox and its Qplayer are currently in beta and in a little exercise we like to call a "Test Of Hypebot's Collective Intelligence", they are asking Hypebot readers to check out the service and tell them what you think.  The best comment or suggestion gets a gift certificate from Amazon.

TVT Bought By The Orchard

Tvt_3 BANKRUPT INDIE SOLD TO DISTRIBUTOR

Orchard_logoUPDATED: TVT Records, home to Lil Jon and other rappers, has entered into an agreement to be acquired by The Orchard. Financial terms are not yet public, but if the court approves, the deal will close July 3rd.  The Orchard will acquire the TVT's catalog and artist contracts but not its music publishing division, TVT Music Enterprises, which will operate as a standalone enterprise.

Is the Orchard expanding from distributor to label and competing with its own clients?  Orchard President Greg Scholl sent a mixed message. "We are committed to supporting the artists on the current roster," he told the NY Post. "But we are not anticipating expanding the roster and signing new artists."

Chant #1 Classical Before CD Release

Chant LONG TAIL, DIGITAL ONLY RELEASE HITS #1

I have seen the future of music and it looks like Chant.  Chant - Music for the Soul  on Decca debuted at #1 on the Billboard Classical Chart and remains the #1 classical release at the iTunes Music Store.

Chant, a niche recording even by classical standards, made it to #1 as a digital only release exclusively through the iTunes. The recording will be released physically in-stores nationwide on Tuesday, July 1st.

Want success in Music 2.0?
Chant this: "I will serve the niches. I will serve the niches. I will serve the niches..."

Qtrax Missing EMI & Universal Hits

Qtrax Yesterday, I chronicled the trouble I was having downloading and playing tunes from the supposedly relaunched Qtrax site. Others agreed and a quick test showed that the problems continued this morning. Perhaps just a annoying given Qtrax history of not delivering on its promises, is that most hit product by EMI and Universal, two labels who said they were supporting the service, is unavailable and labeled: COMING SOON.

Here is  a list compiled by a Hypebot reader of popular Universal and EMI artists that are not available on Qtrax:

Royalty Rate Negotiations Bear Fruit

National Music Publishers' Assn. president/CEO David Israelite confirmed to Billboard that music publishers, record labels and digital music services have agreed on new royalty rates for the next five years limited downloads and internet streaming. The parties have not yet been abke to agree on rates for permanent downloads, ringtones and physical goods.

QTrax Relaunches...I Think.

Qtrax_2 The front page of Qtrax claims that music is available for US users. But my experience and others this morning suggests differently.

Sign up and download of the Songbird based interface (PC only for now) was easy enough and while it said I was downloading a classic Van Morrison track, I couldn't find the file anywhere on my computer. There was a link to it inside the Qtrax player...and that failed to play. If only Luddites like me are the only ones having trouble; I'd love to know. But for now it appears that Qtrax has once again botched a launch.  Is this strike two, strike three or strike twelve.

UPDATE: I can now listen to the song within the Qtrax player on this one PC. (It appears tracks take a while to "verify".) But so far I still can't do anything else with it...

TuneCore Opens Digital Aggregator Platform

Tunecore_2 Flat fee distributor TuneCore is launching a new service which enables other music companies to offer worldwide digital distribution using TuneCore's infrastructure.

TuneCore has already helped democratized the music industry by enabling individual artists easy and inexpensive access iTunes, Amazon, eMusic and other download stores while taking no rights, exclusivity or revenue. Now using Google's open API any music company like management, merchandisers and record labels can act as a digital aggregator. From their own sites, these middlemen can, for example, offer the opportunity for artists to "sign themselves" at a variety of costs and benefits including worldwide digital distribution. See a diagram of how it works after the jump.

ANALYSIS:  Digital distributors are already feeling downward price pressure as artists and labels ask why they need to pay...

FMC Calls For Payola & Localism Scrutiny

Future_of_music_2 The payola settlements of 2007 offered a starting point for radio to make changes that showed a commitment to localism and diversity on the public airwaves. But the reality is that  few broadcasters are placing local and independent music in regular rotation.

In response the Future of Music Coalition has created a Payola Education Guide and filed a brief with the FCC asking for a re-examination of the issue. The lack of transparency in the song selection process at commercial radio stations leaves the door open for payola...

Amazon Lowers Prices, eMusic Raises Them

EMUSIC'S PLAN COULD HURT INDIES

UPDATE: Be sure to read the comments section including an eMusic rebuttal and join the discussion.

Amazon_3 While retaining 89 to 99 cent pricing on most tracks, Amazon is experimenting with lower prices on short term special album downloads.  Taking a page from Wal-Mart's blue light specials which kept shoppers roaming the store to see where the flashing light would land, on Wednesday morning Amazon MP3's "Daily Deal" offered a download of Coldplay's X&Y for $1.99 and Stevie Wonder's #1's album at $2.99. "Friday's Five" will offer five albums at $5 each.Emusic_2

eMusic, on the other hand, announced a price increase. Effective July 17th, eMusic's monthly Basic Plan will increase $2 for all subscribers from $9.99 to $11.99. UK rates go to 10.99 GBP and EU prices jump to 13.99 Euros. Canadian pricing which was already higher will not change. In a move to keep existing subscribers, they will recieve 40 instead of 30 downloads each month and a one time 10 track thank-you bonus.

ANALYSIS: eMusic's price increase comes at a time of slowing subscriber growth for the service and could be part of an attempt to boost the balance sheets in preparation for the IPO or sale that its venture capital owners...

A Look Inside The New EMI

In June 2008, EMI is a sad ship without captains, but there is still hope on the horizon.

Emi_logo Conversations that I've had with EMI staffers and several news reports provide a look inside a beleaguered EMI. Employee morale is extremely low as they wait...and wait for the axe to fall on 1500-2000 of their 5000 or so heads. Artists and managers share similar fears and frustrations over what has been a painfully slow reorganization process. "I just want to know if I have a job" and "We just want to know who will be left to talk to" are two refrains heard often from staff and artist reps respectively.

Sadly, the numbers may also be worse than feared. An analysis by McKinsey and KPMG found that EMI had lost $1.5 billion selling new music in the last five years alone.  Only Beatles, Rolling Stones and other old catalog are keeping the company now laden with debt afloat.

Guy_hands_2 "UNLOCKED YEARS OF INTERNAL BATTLES"
Some gave new owner Guy Hands the benefit of the doubt, but now his sometimes abrasive style and the lack of an obvious plan forward are causing many artists and managers to look for any way out. Hands for his part is giving no ground eyeing EMI's staff and artists with disdain. "It was like we had unlocked years of internal battles with a psychotherapy session,” he said. “It was extraordinary.”

For now Hands is left alone at the top.  One by one, he's removed heads of labels and other key execs. These may be needed moves, but he's left demoralized crews without captains. His executive restaffing has also been slow and in many cases he has no intention of ever filling the posts.
Coldplay
HOPEFUL SIGNS
One bright spot has been a slew of digital appointments grabbing fresh perspectives from the executive suites of Google and other tech companies. But digital is just the delivery pipe whose value rises and falls with the product being fed through it.

Coldplay is certainly delivering impressive early numbers topping most charts worldwide. The Beatles are inching closer to unleashing the digital floodgates. Today's reports indicate that the Rolling Stones may not be leaving after all, and if they do that their lucrative catalog may remain.

PUMPS WITHOUT GAS

What seems to be missing most at today's EMI is an awareness that the signed artists with product in the pipeline need support and that new artists need to be signed and nurtured. This is how profitable catalog is created. One of Guy Hand's early successes was revitalizing gas stations on the autobahn.  From that experience he should have learned that all the clean toilets in the world mean nothing if their isn't gas in the pumps.

Rolling Stones Near Live Nation Deal

EMI THE BIG LOOSER...AGAIN

RollingstonesUPDATED: The Rolling Stones are days from signing a massive 360 deal with Live Nation, according to the Guardian. Since the Stones control much of their catalog, EMI could loose $4.6M USD in yearly revenue. Such a loss would be a major blow to the struggling label group even as new owner Guy Hands' Terra Firm attempts to re-structure it. Universal is rumored to become the new distributor if the deal closes.

Just last week, bickering between Live Nation's top execs over the pace of expensive 360 deals became public. But its hard to imagine that Live Nation's #2 Michael Cohl would allow anything to stop him from completing a deal with his long standing friends and business partners the Rolling Stones.

UPDATE:The Rolling Stones now deny that a label move in imminent. (Billboard/Reuters) Some Live Nation exclusive deals do not include recordings, but I'm guessing anything is still possible
