Tommy-super-deluxeSome of these things claim first, some do not. Some of them are and some are not. But in a postmodern world does history matter? Apparently not. So, instead of playing art history detective or investigative pseudo-journalist or debating some binary question that rigs the discussion, I'll just let you enjoy your own take on these unique and interesting experiments in music marketing from Pharrell, Riz, The Who, Bon Jovi and Katy Perry. Spoiler: the recycled video beats all the firsts.

GoldieBlox vs. Beastie Boys: Justified Parody Or Obvious Ad?

Upward-Spiral-Logo

The story of Goldiblox and the Beastie Boys has gained traction in recent days, and for good reason — it's a nuanced conflict with no obvious resolution. Goldiblox is a start-up toymaker with the noble goal of getting girls into engineering and teaching them STEM skills. Their viral video gave the Beastie Boys' "Girls" a female-empowerment lyric makeover without the band's permission, and then Goldiblox slapped the Beasties with a lawsuit as a pre-emptive defense against any legal action. Should Goldiblox be protected under fair use? Pundits from all sides of music and tech have weighed in, and Upward Spiral co-host Jason Spitz gathered three intelligent and insightful voices for a lively conversation.

Of particular interest is their use of digital billboards as a localized screen for social media. Artistic Efficiency: How to Create More and Get Out of Your Own Way

Michael-shoupBy Michael Shoup, owner of 12South Music and co-founder of Visualive.

Nine years ago, I left college with a Bachelor's Degree in Music. Untested and honestly, quite naive, I spent the next three years using money from designing websites freelance to ineffectively tour as an artist around the country, gigging myself into over $6k of high interest credit card debt. Embarrassed and defeated, I stopped writing, I stopped playing music outside of my home, and my answer to "what do you do?" begrudgingly changed from music to websites.

Pandora Abandons Internet Radio Fairness Act, Turns To Copyright Royalty Board

Pandora-iconYesterday Billboard reported that Pandora is abandoning its efforts to reduce rates via the Internet Radio Fairness Act confirming earlier reports at Forbes. Pandora is now expected to focus efforts on the Copyright Royalty Board to lobby for changes beginning in 2016. So far Pandora's efforts seem most clearly to have resulted in widespread ill will from musicians and labels and pressure on terrestrial radio to pay performance royalties. Though Pandora does face a powerful new rival in iTunes Radio, which is free from the burden of having to succeed as a stand-alone enterprise, it still dominates internet radio and is considered a major Spotify rival despite being available in only 3 countries.

Why The Beastie Boys Should Support Rather Than Shut Down The "Girls" Ad

Goldieblox-660x370If you've seen the "Princess Machine" video from toy company GoldieBlox (embedded below), you'll probably agree with me that it goes beyond fair use of the song "Girls" given the opening music and the overall construction. The court will decide but this seems like a clear case where licensing should have been sought and, on that level, The Beastie Boys are correct in challenging a for-profit enterprise's use of the music. However, I believe The Beastie Boys should work something out and keep the video available to the public because they long ago disavowed the sexual/gender politics of their early music, even asking Prodigy not to play "Smack My Bitch Up" at the Reading Festival. If they're serious, the surviving members of the group should tell the lawyers to back the fuck up because this is the kind of video/ad real girls need to see.
